Service of process on the attorney of record: 5 common errors under Article 170 c.p.c.
5 min read · Updated October 2026 · Editorial oversight: Avv. Federico Papa
The correct application of Article 170 c.p.c. is a cornerstone of the regularity of the adversarial system (contraddittorio) in Italian civil proceedings. Once a party has formally entered an appearance through an attorney of record (procuratore costituito), the latter becomes the exclusive recipient of all services and communications. Although the rule seems straightforward, the transition to the electronic trial (processo telematico) and jurisprudential shifts up to 2026 have complicated its application, particularly regarding the interplay between physical and digital domiciles.
In brief
Under Art. 170 c.p.c., once a party appears in court, all service must be directed to the attorney of record. The primary error is serving the party personally, which results in nullity (nullità) rather than inexistence (inesistenza), allowing for retroactive cure. In the current digital landscape, service via Certified Email (PEC) to addresses from official registries is mandatory. Paper-based service is now considered residual, and its unjustified use may compromise the regularity of the proceedings and lead to procedural challenges.

1. Serving the party personally after appearance
The most common error in legal practice is serving process directly on the party rather than their attorney, violating the first paragraph of Art. 170 c.p.c. According to the established orientation of the Supreme Court (Corte di Cassazione, SS.UU. 14916/2016 and subsequent 2024-2025 rulings), this defect results in nullity (nullità) rather than inexistence (inesistenza). This distinction is vital: nullity can be cured with retroactive effect if the recipient appears or if service is renewed within a court-mandated deadline. However, the error exposes the serving party to the risk of forfeiture (decadenza) if the cure is not timely. To avoid this pitfall, practitioners must verify the opposing party's appearance status before serving any interlocutory documents.

2. Disregarding the priority of digital domicile
In the 2026 regulatory framework, the digital domicile (PEC) holds absolute priority over the physical office. Serving a document under Art. 170 c.p.c. in paper format at the attorney's office when they have a registered PEC address in official registries (ReGindE or INI-PEC) constitutes a procedural breach. According to the combined provisions of Art. 149 bis c.p.c. and Art. 16 ter D.L. 179/2012, digital service is mandatory. Physical service is permitted only in cases of documented technical impossibility or causes not attributable to the sender. The unjustified use of paper service can be challenged as a formal defect and, in some instances, may be evaluated as a breach of the duties of loyalty and procedural fairness (lealtà e probità processuale).

3. Improper handling of multiple attorneys
When a party is represented by multiple lawyers, Art. 170 c.p.c. states that service is valid even if directed to only one of them. Errors often arise from uncertainty about which attorney to choose or the mistaken belief that all must be served. While serving a single attorney is sufficient, it is essential to monitor any withdrawals of mandate (rinuncia al mandato). Under Art. 85 c.p.c., an attorney who withdraws remains the legitimate recipient of service until they are formally replaced by a new counsel, a principle known as perpetuatio of the defense office. Serving a new lawyer who has not yet formally entered an appearance, while omitting the previous one, can jeopardize the validity of the service.

4.4. Failure to monitor interrupting events (death of the attorney)
The death, disbarment (radiazione), or suspension of the attorney of record triggers an automatic stay (interruzione) of the proceedings, regardless of whether other parties are aware. Serving a document under Art. 170 c.p.c. at the office or PEC address of a deceased or disbarred lawyer renders the service nonexistent (inesistente), as the necessary link with the recipient for the very function of service is severed. This differs from the death of the party: if the event is not declared in court or served by the attorney, service directed to the attorney under Art. 170 c.p.c. remains fully valid (Cass. Sez. Un. 15295/2014). Failing to verify the professional status of the opposing attorney before a critical service is a risk that can lead to the loss of the instance of judgment.

5. Using PEC addresses not sourced from official registries
The legal certainty of digital service under Art. 170 c.p.c. strictly depends on the source from which the attorney's PEC address is extracted. It is a grave procedural error to use addresses found via search engines, law firm websites, letterheads, or email signatures. The only valid registries in 2026 remain ReGindE, INI-PEC, and, for public administrations, IPA. Service directed to a 'private' or unofficial address of the attorney is null, as it does not benefit from the legal presumption of knowledge associated with public records. Prior to service, it is the sender's burden to download proof that the address was extracted from an authorized registry to prevent procedural objections.

6. Incorrect service of the appeal after the long term
Particular attention must be paid to the service of the appeal (impugnazione): pursuant to Art. 330, paragraph 3 c.p.c., once the period set by Art. 327 c.p.c. (long term / long-stop period) has elapsed, service must be made to the party personally. The error lies in serving the attorney while ignoring this reversal of the rule provided by the code of procedure after the expiration of said term. Personal service on the party is indeed mandatory in this primary scenario, as well as in other specific instances provided by law (such as the death or disbarment of the attorney), for which reference should be made to the official text of Art. 327 and 330 c.p.c.

Frequently asked questions
Is paper service on the attorney always null if a PEC exists?
Under the current regime, service via PEC is the standard method. Paper service at a physical office is considered irregular (irrituale). If the opposing party appears without raising objections or if the document achieves its purpose, the nullity is cured under Art. 156 c.p.c., but the serving party may be ordered to pay costs associated with the irregular service.
What happens if the attorney changed offices but did not update the Bar registry?
Under Art. 170 c.p.c., service is valid if performed at the elected domicile or the address appearing in the court records. If the attorney fails to communicate a change of address, service at the old office or the PEC address in official registries remains valid for the sender, as the attorney bears the burden of keeping their data updated in public records.
Does Art. 170 c.p.c. also apply to arbitration proceedings?
Yes, within the limits of compatibility. If the parties have granted a mandate to an attorney for the arbitration phase, communications and services follow the rules of the code of civil procedure, unless the arbitration rules or the arbitration agreement provide otherwise regarding the methods of transmitting documents.
